Lucky draw Terms and Conditions
The participant agrees that participation in the sweepstakes with the use of the data provided to him/her above, namely [name, address, e-mail address, telephone number], can be permanently controlled by VAYA Holding II GmbH, Dr.-Helmut-Marsoner-Weg 3C, 6175 Kematen in Tirol, as well as all associated companies: VAYA Fieberbrunn Verwaltungs GmbH, Verwaltungsgruppe Alpenland GmbH, Hotel Pacht Austria GmbH, VAYA Verwaltungs GmbH, VAYA Rent GmbH, Hotel Post Saalbach Verwaltungs GmbH.
Verwaltungsgruppe Austria GmbH, VAYA Verwaltungs Obergurgl GmbH, Resort Achensee Verwaltungs GmbH, (hereinafter “VAYA Resorts” for the purpose of advertising hotel, service and catering services in individual VAYA Resorts sold by VAYA Holding II GmbH and for customer satisfaction related to such products – and needs analyzes are stored and processed and transmitted to the VAYA Resorts Participation in the sweepstakes without processing the personal data for advertising purposes and for sending electronic mail for direct advertising purposes is excluded.
The participant can revoke this at any time by contacting VAYA Holding II GmbH, Dr.-Helmut-Marsoner-Weg 3C, 6175 Kematen in Tirol, and also by email to [email protected]. The revocation takes effect as soon as the declaration of revocation is received and does not affect processing that has already taken place on the basis of the consent given and does not affect other existing contractual relationships with the associated companies of VAYA Holding II GmbH.
Conditions of Participation
Organizer
The organizer of this sweepstakes is VAYA Holding II GmbH, Dr.-Helmut-Marsoner-Weg 3C, 6175 Kematen in Tirol, “VAYA” for short.
Eligible Participants
Natural persons over the age of 18 are eligible to participate.
Employees from the entire VAYA Group and the associated VAYA hotels are excluded from participation.
A person enters the lucky draw by submitting all information to vayaresorts.com or by fulfilling the lucky draw terms and conditions. The participant is responsible for the correctness of the information required for the competition, in particular the e-mail address. The information must be received within the period specified in the lucky draw. The electronically logged receipt is used to check whether the deadline has been met. Participation in the competition is only possible if the participant makes his/her data available for sending advertising purposes.
VAYA reserves the right to subsequently withdraw the prize if it becomes known that the participant was not entitled to participate in the competition or if the participant manipulates the competition in any way technically or organizationally or actively influenced the sweepstakes in any other way.
Participation in the lucky draw is only possible under the conditions listed here. By participating in the sweepstakes, the participant expressly accepts these conditions of participation.
Each participant can only take part in the sweepstakes once in their own name and only by providing a valid e-mail address. Excessive participation with so-called disposable e-mail addresses is prohibited.
The procedure of the lucky draw
Participation in the lucky draw is free.
Participation in the lucky draw takes place via the website www.vayaresorts.com using a designated competition form.
The lucky draw begins on November 5th, 2022 until November 9th, 2022. Within this period, eligible participants will be given the opportunity to enter the sweepstakes online. All entries received during this period will be considered.
The determination of the winner will take place after the end of the lucky draw on camera and will be randomly selected among all those eligible to participate.
The winner will be informed by e-mail to the e-mail address he/she has provided. If the winner does not respond to the prize information by email within 7 days, a new winner will be drawn. The voucher will only be sent by e-mail after the winner has been determined and the agreement has been reached.
The winner’s first name and the first letter of surname and city of residence will be published on vayaresorts.com and corporate social media pages. The participants expressly agree to this form of communication and publication.
Profit and award of profits
The prize consists of a voucher for a stay for the duration of seven (7) nights for two (2) people, including half board in a unit (a room or apartment) in the following participating VAYA hotels: VAYA Fieberbrunn, VAYA Zell am See and VAYA Post Saalbach.
The VAYA Ski Safari is structured as follows:
- Two (2) nights at VAYA Zell am See.
- Two (2) nights at VAYA Post Saalbach
- Three (3) nights at VAYA Fieberbrunn
The voucher includes a 7-day ski pass (7) for two (2) people for the nearest ski resort to the hotel where the stay is spent.
The validity of the voucher is limited. The voucher can be redeemed until one year after its date of issue at the latest.
It is not possible for the winner or any person accompanying them to pass on the prize. If the winner cannot claim the prize, the prize will be forfeited. It cannot be redeemed in cash or in any other way, nor can it be rebooked or exchanged. If the prize cannot be accepted for reasons for which VAYA or one of the participating hotels is not responsible (e.g. in the event of a natural disaster), the winner has no claim for compensation and VAYA cannot be held liable.
The legal process is excluded. VAYA reserves the right to change these conditions of participation without prior notice. Liability for misprints and errors is excluded.

By participating in the lucky draw, the participant agrees that the VAYA Group may use the personal data collected for the purpose of conducting the lucky draw and sending electronic mail for advertising purposes. The participant is free to revoke this consent and withdraw from participation at any time. The winner agrees to the possible one-time publication of the name (first name, first letter of the surname). When participating in the lucky draw, the VAYA Group also uses the data of the participants to send the participant newsletters or similar by e-mail. The participant can revoke this consent at any time with effect in the future.
Choice of law
Austrian substantive law applies to all legal relationships in connection with the conditions of participation in sweepstakes, excluding the conflict of laws provisions of private international law and the UN Sales Convention. The validity of other mandatory statutory provisions remains unaffected by this choice of law.
